Uproar at Council Meeting

Good For Manly Cr Candy Bingham’s motion to discuss the need for a business plan was illegally ruled “out of order” and left off the agenda at Monday’s Manly Council Meeting.  And Cr Bingham’s attempt to have it discussed as a matter of urgency, was also knocked back.

A packed gallery, comprising many representatives of Manly's Resident Precinct groups, expressed their outrage as the Mayor Jean Hay refused to allow the matter to be discussed.
 
The motion, which was to examine the financial viability of the 99 year lease of the Whistler Street site and construction of a 470 space car park under Manly Oval, was prepared by residents of North Harbour Precinct. It had the support of  the majority of the resident precincts and is a requirement of the Office of Local Government.
 
"The council’s existing documentation  is so out of date it was made when the car park was to hold 760 cars, not 470, as is the case now.  The KPMG report also contained significant omissions, such as not taking into account the loss of the $1M a year operating profit currently made by the Whistler St Car Park," Cr Bingham explained.
 
The need is urgent.  The contracts to build the oval car park and redevelop Whistler St are expected to be awarded next month.  At that point, Manly Council and its ratepayers will be locked in, with a penalty fee incurred if the newly merged Council decides to call the projects off.
 
“It’s easy to see why people are upset,” Cr Bingham said.
 
“While the planned 99-year lease and development of the Whistler St site will partly fund the new oval car park, the down side of that deal is that we lose convenient parking in Manly CBD and the potential for a new CBD plaza.  We also lose a key site in Manly at a time when the Council is to be expanded."

“The remaining cost, including any price overruns, or operating losses, will come out of the pocket of Manly businesses and rate payers.”
 
At the end of the day, Manly CBD will lose up to 100 on-street parking spaces and gain a pitiful 40 extra spots further away.  
 
“It’s the ‘why bother’ Car Park,” Cr Bingham said. "Why are the Liberal Councillors hell-bent on pushing this through before the Council is amalgamated?  It's irresponsible".

Now is the time for the legal fight. An injunction to stop this stupidity before the contracts are awarded would be the first step.

The developers of this debacle should be made aware they will be in for a long and costly fight. Its a pity the ratepayers are the ones who will bear the brunt of the costs be they the legal defence from the council or the rate impositions in the future.

You are right Bruce, normally an injunction at this time would be the way to go. The only problem is that the tender clearly states it is up to the winning contractor to get all necessary approvals from RMS, Dept of Lands etc etc.

You would think THAT would be enough to put them off!

Regarding the winning company having to sort out the councils mess, while it gets approval from various legal bodies, this only encourages "short cuts" to save money on this ill fated project.
Jean hay should hang her head in shame at the bully-boy tactics this council is encouraged to utilise....

The big problem with the oval car park proposal is that we are being told "kiddies it's for your own good". This approach to governing is usually an immature approach used by people who either don't care for their constituents or are under undue pressure to get things done. Either approach is disrespectful. Good luck to those who are fighting to find the truth about the car park proposals.

Why arent the figures transparent and published to the wider community of us ratepayers who comprise solicitors accountants economists business planners etc who are more than capable of annalysing and commenting on this project to achieve a truly acceptable and viable result accross the board.
Making a move which may seem a financial step forward is not enough justification to reduce the convenience and amenity of the local villagers.
It may be that an innovative solution lay in redevelopment of the Darley St schoolground into multilevel parking which could also incorporate a safer and more convenient parents' off street pickup point.
This might be a joint project which may also benefit both Department of Education and Council and could be self funded by Council controlled moderate parking fees.
The school playground should function successfully on the top of such a project.
Attention will be diverted from the current doubtfull oval project into a plan that will gain enormous public support and gather
momentum in its approval which may precede any forthcoming amalgamation.

What discussions have been undertaken with the emergency services who use Sydney Road - also what about the bus services who use Belgrave Street and Sydney Road. Living on Sydney Road above the Park I am very much aware of this traffic and the important service they supply to the public. The other point is where will the buses park in between trips?

I am not familiar with the legal process involved. Is there any other process we can resort to to declare we have no confidence in the current council's management on this expansive, and financially disastrous project.

We agree with almost every argument against this Car Park proposal;. Surely we MUST be able to rein in this absurd idea.
